Terms and Conditions
These Terms and Conditions ("Terms") govern access to and use of the websites, applications, and services operated by PCL Builder, LLC, a Wyoming limited liability company ("PCLBuilder," "Company," "we," "us," or "our"), including the PolicePCL platform, the PCL ("Pocket Check List") print and digital products, pclbuilder.com and policepcl.com (collectively, the "Services"). By accessing or using the Services, you ("Customer," "Agency," or "you") agree to be bound by these Terms. If you are entering into these Terms as an individual, on behalf of a law enforcement agency or other organization, you represent that you have authority to bind yourself or that organization.

1. Description of Services
PCLBuilder provides pocket reference and decision-support content for law enforcement and other public-safety agencies, delivered as printed manuals and/or through the PCL digital subscription platform. The Services organize legal, policy, and procedural guidance into a layered reference architecture (federal, state, and agency-specific content) but do not constitute legal advice.
2. Eligibility and Accounts
2.1 The Services are intended for use by individuals, businesses and law enforcement agencies, allied public-safety organizations, and their authorized personnel. You must provide accurate registration information and keep your account credentials confidential.
2.2 You are responsible for all activity that occurs under your account and must notify PCLBuilder staff promptly of any unauthorized use.
2.3 PCLBuilder may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a security or misuse risk.
3. Agency Content and Materials
3.1 To build or customize an Agency's PCL, PCLBuilder may request the Agency's policy and procedure manuals and related internal materials ("Agency Materials").
3.2 Agency retains ownership of its Agency Materials. Agency grants PCLBuilder a limited, non-exclusive license to use, reproduce, and adapt organizational or Agency Materials solely to create, customize, update, and support that organization or Agency's PCL and related deliverables. This includes the storage of policy documents, its contents in digital and print forms, including but not limited to using the data to read, analyze and condense large policies and manuals down to a form factor that fits a PCL book.
3.3 Agency represents that it has the right to share the Agency Materials it provides and that doing so does not violate any law, contract, or third-party right.
4. Subscriptions, Fees, and Payment
4.1 Access to PolicePCL and related digital Services may require payment of subscription fees as set out in an applicable order form, quote, or agency pricing agreement.
4.2 Unless otherwise stated, subscription fees are billed annually in advance and are non-refundable except as required by law or as expressly stated in an applicable order form.
4.3 PCLBuilder may change subscription pricing prospectively with reasonable advance notice before the start of a renewal term.
5. Intellectual Property
5.1 The PCL content architecture, card format, layout, numbering standards, PolicePCL platform, PCLBuilder trademarks and logos, and all underlying software are the exclusive copyrighted and trademark-pending property of PCLBuilder or its licensors and are protected by intellectual property laws.
5.2 Subject to your compliance with these Terms and payment of applicable fees, PCLBuilder grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your Agency's internal law enforcement and training purposes.
5.3 You may not: (a) copy, resell, sublicense, or redistribute the Services or PCL content outside your Agency; (b) reverse engineer or attempt to extract the underlying content architecture or numbering methodology; (c) remove proprietary notices; or (d) use the Services to build a competing product.
6. Acceptable Use
You agree not to use the Services to: (a) violate any applicable law or regulation; (b) upload malicious code or attempt to compromise the security of the Services; (c) misrepresent your affiliation with a law enforcement agency; or (d) interfere with other users' access to the Services.
7. Disclaimers
7.1 No Legal Advice. THE SERVICES, INCLUDING ALL PCL CONTENT, ARE PROVIDED FOR TRAINING AND REFERENCE PURPOSES ONLY AND DO NOT CONSTITUTE LEGAL ADVICE. Laws, regulations, and agency policies change over time and vary by jurisdiction. Agencies and personnel remain solely responsible for verifying content against current law and their own agency policy before relying on it in the field.
7.2 "As Is." THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PCLBUILDER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, REVENUE, OR GOODWILL, ARISING FROM OR RELATED TO USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. PCLBUILDER'S TOTAL AGGREGATE LIABILITY ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE FEES PAID BY YOU TO PCLBUILDER IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
9. Indemnification
You agree to indemnify and hold harmless PCLBuilder, its members, officers, and affiliates from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your breach of these Terms, misuse of the Services, or violation of applicable law.
10. Termination
PCLBuilder may suspend or terminate your access to the Services for breach of these Terms, non-payment, or as otherwise permitted herein. You may terminate a subscription in accordance with the terms of your applicable order form. Sections 5, 7, 8, 9, and 12 survive termination.
11. Changes to the Services or Terms
PCLBuilder may update these Terms or modify the Services from time to time. Material changes to these Terms will be communicated by posting an updated version with a new "Last Updated" date, or by direct notice to Agency account contacts where required. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
12. General Provisions
12.1 Governing Law. These Terms are governed by the laws of the State of Wyoming, Albany or Laramie County without regard to conflict-of-law principles.
12.2 Entire Agreement. These Terms, together with any applicable order form or Expectation of Performance (EOP) document, constitute the entire agreement between you and PCLBuilder regarding the Services.
12.3 Severability. If any provision of these Terms is held unenforceable, the remaining provisions remain in full force and effect.
12.4 No Waiver. PCLBuilder's failure to enforce any provision is not a waiver of its right to do so later.
